    Definitions and Interpretation

    In these Terms of Service, unless the context otherwise requires, the following expressions have the following meanings:

    By “You/Client” , this also includes any person that accesses or uses Consult by FD on your behalf.

    By “We/Us/Our” we mean Consult by FD.

    Client

    To become an Online Client, you must provide your postcode, phone number, and email address. You become an Online Client when you complete your digital payment transaction for your online service, complete our Discovery Questionnaire (to help us best understand your project scope and budget) and book a virtual consultation with us. The questionnaire is your first opportunity to set out the parameters, and expectations, of your project.

    You warrant and confirm that the Client Information you disclose to us will be sufficient, accurate and complete in every respect.

    In order to become a Full Design Service client you must email us at hello@consultbyfd.com and get your project approved by our design team.

    Online Design Services Commencement and Duration

    The relationship between us (Consult by FD) and Clients (you) is governed by these Terms, effective from the project start date.

    Based on the Client Information and Discovery Questionnaire, and subjects covered in our consultation, we then get to work curating your mood board and concreting your brief. We send this to you via email for approval before proceeding onto 2D layouts.

    You acknowledge and agree that any 2D and 3D designs we produce for you is intended for illustrative and inspirational purposes only and is not intended to provide an exact specification for an interior design project nor to guarantee specific results, nor will it necessarily comply with any relevant construction laws, regulations or guidance, whether statutory or non-statutory.

    Liability

    While Consult by FD make every effort to portray recommended products and their colours and materials in the most accurate way through email, the displayed colours of the products will depend upon the monitor of the user and cannot be guaranteed by Consult by FD as an accurate portrayal of the actual colour or material of the product. We also make efforts to estimate scale of your space based on photos and dimensions provided, but can’t guarantee that all recommended products will fit your space. It is the Clients’ responsibility to measure their space to ensure that items fit prior to purchasing.

    Consult by FD do not accept any responsibility or liability for any incorrect furniture or fixtures ordered by you or a third party, or furniture that may be the wrong size, wrong colour or arrive damaged.

    Consult by FD work on the assumption that all clients check the dimensions of the furniture pieces recommended to them before purchasing. Consult by FD will not accept any liability or responsibility for furniture ordered by you that is not to your satisfaction or needs to be returned for any other reason.

    It is your responsibility to check any product ordered by you will pass freely into the room of choice, that they will fit in that room, can be transported via any door, stairs and doorways, and there are no other issues that could add difficulties to delivery or frustrate delivery. Consult by FD will not accept liability for any purchases, alterations made in relation to the 2D or 3D illustrative image.

    While Consult by FD will attempt to ensure that all retail product links are current in order to assist users with purchasing the products, there is no guarantee that the furniture or accessories recommended by us will be available for purchase at all or within a specific time frame defined by the Clients in their questionnaire. If prices are provided as part of the design service recommendation, there is no guarantee that the Client will find the article at the same price when they order. Consult by FD cannot guarantee availability or workmanship of any products purchased from outside vendors.

    If you are dissatisfied with Consult by FD your only remedy under the Terms shall be to discontinue your use of the service and the site. Without limiting the preceding sentence, we shall have no liability for any failure or delay resulting from any matter beyond our reasonable control.

    Without limiting the foregoing, under no circumstances shall Consult by FD be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control, including, without limitation, Internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labour disputes, riots, insurrections, civil disturbances, shortages of labour or materials, fires, floods, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, non-performance of third parties, or loss of or fluctuations in heat, light, or air conditioning.

    Consult by FD is an interior design studio that also offers virtual interior design services. Where we discuss your specific design needs, this should not be treated as advice, but guidance and for information only;

    While reasonable efforts are made to ensure our Virtual Design Proposal matches your needs, the Design Plan (and any plans, specifications, lists, information and documentation whatsoever it contains) is for illustrative purposes only and not to be solely relied on; and at all times you must rely on your own due diligence in evaluating and seeking to implement the Design Proposal including all furniture recommendations.

    Consult by FD reserve the right to revise and amend these Terms from time-to-time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in our services offered and changes in relevant laws and regulatory requirements.

    Communication

    Each package offers ‘post design support’ with us, during which period we are available by email for support and guidance. For clarity, ‘post design support’ does not include further substantial design work outside of the package.

    At all times during the design process, you are under an obligation to respond promptly and fully to us. We will endeavour to communicate with you via email and phone calls, but should contact with you cease for up to three months, or you fail to provide responses to us that we consider to be satisfactory in assisting progression of your design, we will regard your project as completed and no further work will be carried out and we reserve the right to terminate our Services forthwith in those circumstances.

    We will be contactable by e-mail for the duration of the project. Response times will be 24 hours GMT from the next Business Day, whichever is the later. We will also be available post completion of your package (please refer to the individual plan for details of timing).

    Third Parties in Design Proposals

    Our Design Proposal may specify third party products that we reasonably believe may assist in implementing your design needs. We make these recommendations in good faith, but: without offering or implying any warranty as to the fitness of the goods or services provided, a matter on which you should use your own due diligence;

    We will not be liable for any losses or damages or other adverse financial consequences arising from a breach or failure on the part of a third party contractor. You acknowledge and agree that in regard to contractor and retailer, etc. recommendations in the virtual Design Plan, Consult by FD act strictly as a third party referrer and not a provider of such trades, goods and services of any kind, and all contractual relations and arrangements concerning the provision of such trades, goods and services are entirely a matter between you and the relevant contractor(s) and/or retailers and others.

    Consult by FD are in no way responsible or liable for the provision of such services, and you indemnify us entirely in respect of the financial consequences, loss, damage, any breach of contract or breach of duty on the part of you or the third party provider in the provision of your services;

    Consult by FD will reasonably endeavour to ensure that all retail product links provided to you in the Design Proposal are current on stock to assist with purchasing the products, there is no guarantee that the furniture or accessories recommended by Consult by FD will be available for purchase at all or within a specific time frame defined by you in your brief to me. If prices are provided as part of the online design recommendation, there is no guarantee that you will find the article at the same price when you seek to order it.

    On Site Design and Optional Extras

    If you select a package that includes a Virtual Consultation, you acknowledge and agree as follows:

    Virtual Consultations are restricted to take place online, digitally as a video conference.

    We will use reasonable endeavours to agree and book a Virtual Consultation with you at a time and on a date that is convenient to you, but we offer no guarantee.

    While we may undertake indicative measurements of rooms and spaces on site, this will be for guidance and illustrative purposes only and it will be your responsibility to review, ensure and verify the accuracy of such measurements to your own satisfaction.

    Sales, Delivery, and Return policies

    Pricing for product and services listed on consultbyfd.com are quoted in GBP British pounds and all prices are subject to change.

    We occasionally make available promotional discounts for online design packages but these will not be applied retroactively to purchases that have already been made. Furthermore, these are personalised promotions and therefore only for the Client in receipt of the promotion.

    For our online services, we take full payment up front via our website and will only start work on your Design Proposal once payment and all Client Information have been received. We allow you to book a Virtual Consultation, at a time convenient to you, to kick start your project.

    Consult by FD guarantees that each user will receive design proposals and recommendations based on the questionnaire, pictures, videos or other material submitted by the user. Design is inherently subjective, however, and you agree that Consult by FD cannot and does not warrant or guarantee your satisfaction with design services and/or ideas you receive on the Consult by FD site. Notwithstanding the foregoing, Consult by FD will take such reasonable steps, in our sole discretion, to ensure your satisfaction, including but not limited to those measures set forth in our Refund Policy.

    Refunds + Revisions Policy

    You may cancel our services up to two weeks (14) days before the start date by notifying us via email, in which case you will be refunded the Client Payment. If the cancellation request is received less than two weeks (14) days before the start date, you will not be entitled to a full refund. This will be at our discretion.

    If you are not satisfied with the Service, then you may ask for specific remedies to fix the situation by emailing hello@consultbyfd.com. We allow up to 2 revisions per design, this consists of a change of up to one mood and one layout. On receipt of your revision requests, we reserve the right to request payment of additional fees before continuing further work where we are reasonably of the view that your request(s) will involve a substantial revision to the design proposal.

    For clarity, where a package includes 3D renders of designs, ‘revision’ eligibility does not include additional 3D renders. Any such requests will be treated as substantial material revisions to the Design Plan and a quotation for additional fees will be provided to you.

    At Consult by FDs’ discretion, we will offer a refund in those situations where a remedy is not possible or does not fix the issue. You can request a refund by emailing hello@consultbyfd.com. The refund is limited to the amount paid for the service. The amount due will be calculated in proportion to the full price of the Interior Design Services and the actual Interior design Services already provided. Any sums that have already been paid for the Interior design Services will be refunded subject to deductions calculated on this basis.

    Client Reviews

    You may from time-to-time be asked by us to provide qualitative feedback or a rating for the Service, or both. We may anonymise or pseudonymous reviews on request by a Client, or otherwise for the purposes of data protection where a Client’s account has been closed or terminated.

    Your Warranties and Obligations

    You warrant that:

    • You are 18 years of age or older;

    • You have provided accurate and valid information requested during the registration process;

    • You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the design proposal without the express written permission of us, Consult by FD.

    Payment Methods and Information

    Your payment information is processed via a third party eCommerce Payment Processor Stripe which is integrated on our Site, in accordance with such eCommerce Payment Processors’ terms and policies. Our Site host Squarespace transmit your complete payment information when you initially provide or update it only so that they can pass it along to the eCommerce Payment Processors we use on our Site. Neither Consult by FD or Squarespace collect or store your payment information.
